Standards Australia to remove standard from circulation

Standards Australia will be removing a standard from circulation AS/NZS 4755.3.3:2014  Demand response capabilities and supporting technologies for electrical products, Part 3.3: Interaction of demand response enabling devices and electrical products – Operational instructions and connections for electric storage and electric-boosted storage water heaters from circulation.

Standards Australia became aware that elements of this document may be subject to patent rights held by Rheem Australia.

In line with its Patent Policy, Standards Australia is unable to provide authoritative or comprehensive information about the evidence, validity or scope of patents or similar rights.

In instances where a standard or other technical document is developed and a relevant patent or patent application has been disclosed, Standards Australia requests the patent holder to provide a written statement using the appropriate Patent Statement and Licensing Declaration Form to be filed with Standards Australia.

In the case of AS/NZS 4755.3.3:2014, while Standards Australia and Rheem have engaged in lengthy negotiations, a “Patent Statement and Licensing Declaration” has not been provided on terms satisfactory to both parties.

As a result, Standards Australia is removing AS/NZS 4755.3.3:2014 from circulation with effect from 26 July 2024 and will be notifying users and other relevant stakeholders in due course.
